论我国低位阶法的三种特殊时间效力

“中国尚无以法到达日期作为生效时间的制度”的断言不够严谨，我国低位阶的法不仅存在这种法的生效形式，而且存在自某日零时生效、旧法自新法文到之日起失效的形式。在市场经济、现代科技、电子商务、电子政务条件下，这些形式具有保障经济平稳高效运行的特征，反映出现代法律重视安全、秩序等法律价值的特点。法理学、立法学界应当给予足够的关注。

On Three Special Kinds of Validity in Time in China's Law of Low Levels

The statement that there is not a system which take the date of law＇s arrival as time of taking affect in our country isn＇t exact, because Chinese law of low levels not only has it, but also has forms of new law＇s going into effect from zero hour of a certain date, of old law＇s becoming invalid from the date of new law＇s arrival. On conditions of market-oriented economy, modern science, e-business, e-government, these forms have feature of ensuring economy running smoothly and efficiently, and reflect the character of modern law＇s paying great attention to legal values of safety, order, etc. The circles of jurisprudence and legislative science should pay enough attention to it.
