刑事被害人国家补偿制度刍议

本文以一个典型案例为切入点突出我国在保障被害人财产权益方面的不足,进一步分析完善被害人救助制度的重要性和必要性。通过评析我国现行法关于刑事被害人财产权利赔偿的规定,对比国际社会的通行做法,主张在我国亦应建立刑事被害人国家补偿制度,以期更好地保护被害人的合法的财产权益,从而避免被害人二次受害。结合我国的现实状况,对国家补偿制度进行了初步的设计。

A Preliminary Study of National Compensatory System for Criminal Victims

Through a typical case , we see the shortcomings in the protection of the victims of property rights in China, further analyzing the importance and necessity of establishing the victim assistance system. Then through commenting on China's existing laws on property rights of criminal victims compensation, compared international community practices, it is thus concluded that China also need set up criminal victims compensation system, in order to better protect the victims of legitimate property rights, so as to avoid secondary victimization of victims. With the reality of our country, the national compensatory system is designed in the end.
