论不动产预告登记制度

摘    要:不动产预告登记制度的性质是将债权物权化,赋予债权请求权以物权的对抗效力,其制度价值在于保护不动产债权请求权,平衡不动产变动各方当事人的利益,充分认识预告登记制度的适用范围,要件,效力及预告登记义务人的抗辩义务,对于完善《中国物权法草案建议稿》中的不动产预告登记制度有着重要的意义。

Abstract:Regulation of advance notice registration is one of the important institutions of property rights in the German and Japanese civil law. The nature of regulation is to make property rights replace creditor's rights, balancing the interests of the persons related in the changing of the immovable property. This article probes into the range of application, important conditions, effects, and the counterplea of the duty person of the advance notice registration, and gives the author's viewpoints on how to improve the regulation of advance notice registration in The China Proper Rights Law(draft for advice).
