在社区矫正审前评估程序中引入担保制度的探索

在社区矫正审前评估程序中引入担保机制，是近年来成都市社区矫正试点工作中着力推进的一项重要内容。部分试点地区的司法实践效果表明，通过运行担保程序，可充分调动社区力量参与到社区矫正监管工作中来，这有利于充实监控力量。本文对审前评估程序中引入担保机制的重要意义、审前评估程序中担保机制的制度设计（包括担保主体及具体要件、担保程序、担保人职责等）以及进一步完善担保制度需要解决的问题等进行了探索，希冀对充分发挥该制度的作用以预防和减少刑释人员再犯罪有所裨益。

A Research into Guarantee Introduction System in Pre-trial Evaluation Process in Community Correction

On the community correction pretrial evaluation process of introducing insurance mechanism, in recent years, the Chengdu city community correctional work efforts to promote an important content, pass to be guarantor credit assessment, can fully mobilize the power of community participation in the community correction supervision work, full of the monitoring force. In this paper, through extensive investigation and thorough practice, in pretrial evaluation stage to introduce guarantee system demonstrates the feasibility of community correction, and the guarantee mechanism for the connotation, the guarantor duty, guarantee implementation are discussed, the hope for preventing and reducing crime again helpful ex-convict personnel.
