| 摘 要： | 我国关于缓刑适用实质条件的规定 ,应当向西方缓刑制度较为发达的国家学习 ,将有关条件予以量化。具体步骤为 :(1)将缓刑适用实质条件在法律中明确加以列举 ;(2 )将影响对犯罪人适用缓刑的各种实质性因素进一步量化。

| Abstract: | We should use the experience of developed countries in suspended sentence when we are going to amending the norm of criminal law on the substantive conditions of suspending the sentence. This action includes two steps: (1)Enumerating all substantive conditions that can lead to suspending the sentence in the criminal law. (2)Changing the substantive conditions that can lead to suspending the sentence or not into amount which can show clearly if we should suspending the sentence. |
