浅析我国的无效婚姻和可撤销婚姻制度

已经成立的婚姻不一定有效,有效的婚姻则一定成立。当成立的婚姻不具备法定的有效要件时,法律就会认定其为无效婚姻或可撤销婚姻。无效婚姻和可撤销婚姻有其相同点和不同点,对其认定也涉及一系列社会问题。我国现行《婚姻法》有关无效婚姻和可撤销婚姻的规定有突破性进展,但仍存在着许多不足之处,需要完善。

Established marriage may not valid, however, valid marriage is certainly established. When established marriage lacks important document which is legal and valid, it will be declared no longer valid or will be cancelled by law. Invalid marriage and marriage which can be cancelled have something alike as well as something different,and how to distingwish them involves in a series of social problems. Although the new Marriage Law of our country has a breackthrough in regulating the above two illegal marriage,it still has defects to consummate.
