论高校学生处分的原则

我国当前的法律规定,高校具有对违纪学生的处分权,但对处分权的使用原则并无详细的规定与说明,这样导致高校在实施处分权时侵犯了学生合法权益。因此,根据社会主义法治精神,高校处分应该遵循合法性原则、程序性原则、公开公正的原则、权益保障性原则、处分与教育相结合的原则。

On Principles of College Students' Sanctions

According to China＇s current law the universities hold the right of disposition on students breached principles,but there are no detailed regulations to specify implementation principles,so it leads to violation of college students＇ legitimate right and interest under implementation.Thus,according to the socialist law spirits,university sanctions on students should follow the principles of legality,procedural open and fair,protection of rights and interests,the principle of combining education and punishment.
