克隆技术的宪政视角

克隆技术是当今世界争论不休的一个话题。宪法学考虑的是:克隆技术在多大程度上受到科学研究自由的保障和限制。关键的问题是如何考量克隆人的影响。克隆人的出现影响的首先是宪政的基本价值,即人的尊严和生命价值,克隆人的出现不可避免的会亵渎人的尊严和生命的价值;克隆人的出现也会对宪法最基本的权利———自由和平等产生颠覆性的冲击,会造成新的奴役制度和新的不平等的现象。对于克隆人的挑战,宪法学应该正确厘定科学研究自由的范围和界限,应该区分治疗性克隆和生殖性克隆。

Constitutional Perspectives on the Clone Technology

The clone technology is a topic of endless debate at the present world. What the constitution dealt with is what degree the done technology was protected and restricted by freedom of scientific technology. The first problem is how to considering the effect on cloning human being. Cloning human being first influences the essential value of constitutionalism, that is the dignity of human being and value of life, and subversively impacts the basic human rights of and equality, and leads to a new slavery and unequality. To the challenge from cloning human being, the constitution should be given a range and limit of freedom of learning and scientific research, and a distingnishment between the therapeutically clone and reproductive one.
