完善我国民事司法救助制度的思考

我国现行民事司法救助制度缺乏完整统一的法律体系,救助对象范围较狭窄,申请救助的条件比较抽象,缺乏不服驳回司法救助申请的救济程序,没有规定撤销救助的程序,存在诸多缺陷,成为制约民事司法救助工作继续发展的主要因素,应当从立法上加以完善。

Considerations on the Improvement of the Civil Judicial Salvation System in China

The legislation of the civil judicial salvation system has lagged behind the demand of actual advancement in China,as is evident in such defects as the shortage of the unified legislative provisions,the limited coverage of salvation objects,the abstractness in the provisions of salvation application,the paucity of the relief mechanism to handle cases of refusal to accept the judgment by the court,and the absence of the judgment revocation system,etc.As such,great efforts must be made for improvement in terms of enhancing the legislative level,enlarging properly the coverage of objects for civil judicial salvation,clarifying the terms of suitability for civil judicial salvation,perfecting the relief procedure for refusal to accept the rejection of application for judical salvation,and instituting the procedure for the revocation of civil judicial salvation,etc.
