| 摘 要： | 新《刑事诉讼法》对监视居住制度进行了一系列的重大改造,在一定程度上回应了以往监视居住引发诟病的问题,但该制度在自由裁量权、适用公平性、外部监督等方面仍然存在隐忧,有必要进一步改革完善。
