我国劳务派遣用工法律规制的嬗变及其本质研究

劳务派遣用工是一种新兴的用工形式，这种形式大大地补充了传统的用工模式。这种形式最早起源于美国，在我国的兴起时间并不长，也取得了一定的效果，但是旧的劳务用工存在着很多的弊病。针对这一弊病，2012年的人大常委会通过了对旧的劳务派遣用工的改革，大大弥补了这一缺失，也更体现了“以人为本”的理念。本文主要针对我国劳务派遣用工规则的修改进行说明，并透过这一现象看清其改变所透析的本质。

Research on the Transmutation and Essence of China's Legal Regulation of Labor Dispatching

Labor dispatching is an emerging employment form, which greatly augments traditional employment patterns. This form originated in the United States, and the time of its rise in China is not long, but we also achieved some results, at the same time, there are a lot of shortcomings in the old labor and employ-ment. In response to this drawback, the Standing Committee of the National People＇s Congress adopted the reforms on the old la-bor dispatching in 2012, greatly making up for this loss and highlighting the ＂people-oriented＂ concept. This paper focuses on the revision of the labor dispatching in China, and analyzes the essence of the transmutation.
