| 摘 要： | 在改革脱困过程中，大批职工被裁减下来，下岗、失业成为社会经济生活中的常见现象。但由于《劳动法》自身的不完善，加之一些政府部门和企业把脱困措施简单化，裁员手段行政化，致使部分职工的合法权益受到侵害。从维护职工的合法权益入手，在理论与实践的结合上，比较全面地论述了我国劳动法实施中存在的问题及对策。

| Abstract: | In the process of reform and eradicating difficulties,a large number of staff have been laid off,consequently unemployment becoming a common phenomenon.Owing to the imperfection of Labour Law ,and the simplification of measures taken in government agencies and enterprises,etc.,the workers' legal rights and interests are infringed upon.To protect staff's legal rights and interests,the paper makes a theoretical and practical analysis of the problems existing in Labour Law and their countermeasures. |
