| 摘 要： | 网络的兴起使得信息达到了前所未有的共享程度，也使作品的版权保护问题显得日益重要和紧迫，而现有版权法在权利人的权责、拆讼管辖、案件取证等一系列新的问题面前陷入尴尬境地，明确版权人和网络服务商在网络空间的权责是首先需要解决的问题，也是现有版权法完善的关键与突破口。

| Abstract: | The copyright problem in Internet was brought forward through enumerating some typical examples. The disadvantage of present copyright law was analyzing. At last, it is pointed that the prescribing of right and obligation of authors and ISP in Internet space is the key to problem. |
