完善我国精神损害赔偿制度的立法思考

明确精神损害概念，从立法上确认精神损害赔偿制度；规定一般人格权的保护，扩大对精神损害客体和精神损害赔偿的适用范围；扩大权利主体，保护继承人依法享有的权利；在责任方式上，采取财产方式的非财产方式并重的“双轨制”；确立精神赔偿具体数额的幅度，以便于司法实践操作。

Considerations on Perfecting the Legislation of Compensational System of Moral Impairment

This paper considers it important to Make clearly the concept of moral unpairment to establish the compensational system on legislation,stipulate the protection of the right of human dignity to broden the applying limit of moral impairment object and conpensaticn, increase the right - mastered subject to protect the legitimate right of heirs,adopt the dual system which lays emphasis on property formula and non-property formula and establish the scope of the concrete sum of moral impairamental compensation to facilitate the judicial practical management.
