| 摘 要： | 先用权理论有效地平衡了先发明人和先申请人的利益。专利侵权纠纷案件审判中,先用权适用问题越来越突出。而先用权的界定和适用仍然存在分歧。适应时代发展的要求,清晰先用权适用相关问题在法学教学和司法实践中已成为一个重要课题。
