赌博犯罪立法问题研究

我国现行刑法对赌博犯罪规定，存在诸如犯罪行为归纳欠严谨等问题。鉴于赌博犯罪形态的实际状况．应当将赌博犯罪分设为普通赌博罪、开设赌场罪和私自发行、销售彩票罪三个罪名。应当对未成年人、国家工作人员参赌作出特殊规定，确定单位赌博犯罪。应当提高赌博犯罪的最高刑期，加重罚金刑，取消管制刑在赌博犯罪中的适用。

Researches on Legislation of Gambling Crime

There are some flaws in stipulation of present chinese criminal law on gambling crime,for example,the conclusion of criminal manners is not strict enough.In the light of practical situation of gambling crime forms,we should divide gambling crime into common gambling crime,the crime of setting up gambling houses and the crime of distributing and selling lottery tickets in private.And a special stipulation for the immature and national working personnel should be formulated and gambling crime of a collective should be defined.Furthermore,the penalty time should be lengthened,the fine be increased,and the application of control penalty for gambling crime be cancelled.
