| 摘 要： | 不动产优先权制度是我国立法史上一项崭新的制度.不动产优先权体现了现代民法的公平观念和保护弱者利益的原则,其特征决定了它在适用上的严格性.就合同法对不动产优先权的规定而言,尚存缺陷和不足,有待于司法解释予以完善.
