| 摘 要： | 打击贿赂犯罪是我国目前反腐败工作的重点之一。贿赂犯罪作为社会腐败的恶源除了在预防教育和“严打”之外，仍需要研究一些有效的法律机制，以遇制腐败现象的发生。贿赂犯罪中，受贿人所收受的“贿赂”，其范围应该如何界定，法学界一直以来都在争议，根据我国刑法对“贿赂”范围的基本问题进行分析，建议贿赂犯罪的本质决定“贿赂”的范围界定应扩充。笔者认为，根据贿赂犯罪的本质及惩治腐败的现实；调整刑事法律结构，完善有关规定；打防结合，标本兼治。

| Abstract: | More people are now attributing bribery crimes as the root of social corruption,and regarding cracking these crimes as one of the keys to anti-corruption campaign.For this purpose,some legislative issues still need proper addressing,for example,bribery has not been definitely defined,and there have been controversies for a long time ever since.This paper studies the current situation in China in this respect,and suggests that more should be included as bribery activities once they fulfill the conditions.The paper concludes that remedy shall be made in consideration of the nature of bribery crimes and today’s urgent demand so that these events could be either prevented or contained. |
