| 摘 要： | 有些纠纷所涉及的社会关系没有纳入国家法律体系的范围，成为“超越法律”的纠纷，同时却又是必须应对的纠纷，要满足纠纷解决的需要而又不危及国家法治的统一性，就需要寻找一种“超越法律”的纠纷解决机制存在的空间，多元纠纷解决机制和民间法为此提供了进路。

| Abstract: | Some social relations the dispute referred beyond the range of the national legal system become the dispute of Overcoming Law, and this kind of dispute must be coped with. In order to meet the need of dispute solution and remain the unity of the national law, we have to find a space for the Overcoming Law, to which an approach may be provided by the multiple-mechanism for dispute resolving and the civil law. |
