| 摘 要： | 共同侵权行为的＂共同性＂要件,分为客观共同关系说、主观共同关系说。客观共同说缺乏主观归责性,不符合侵权法的＂自己负责＂原则,不应为共同侵权行为要件说采纳。主观共同关系说应包含行为人主观上存在共同过失的情况。
