试析全球治理的合法性

本文尝试从四个方面对全球治理的合法性加以探析:全球治理体系规则与一定价值取向的社会公共观念、文化、价值观具有一致性,而后者往往是前者获得合法性的基础;全球治理与社会公众之间是一种良性互动过程,它既包括前者通过满足后者的公共利益或公共需求而获得自愿认同、服从和支持的一面,还包括前者通过政治社会化途径使后者获得治权参与治理的另一面;全球治理体系体现着社会生活的内在正义与秩序, 而社会生活的内在正义体现为民主、自由、平等、保护社会权利和控制公共权威的权力等方面,这意味着承认全球治理的必然性;全球治理的模式也应该是不断进化发展的自生自发的政治秩序逻辑性选择而非人为设计的结果。

Justifying Legitimacy of Global Governace

This article offers to analyze legitimacy of global governace from four aspects. First, the principles of a global governace system should be in line with certain values and social public concepts. Culture and values share many common features, and the latter provides foundation for the legitimacy of the former. Secondly, the relationship between global governace and the public should be one of positive interactive process. In this model of dynamic relation, the former should satisfy the latter's public interests or needs in order to obtain conformity from the latter; and the former should also ensure the latter's rights of participation in governace. Thirdly, the system of global governace is supposed to reflect its internal order and justice actualized in the terms of democracy, freedom, equality, security of social rights and control of the rights of public authority. This means recognition of global governace as inevitable. Fourthly, the mode of global governace should be progressive, spontaneous and a logical selection of political order, not an arbitrary design of anyone.
