试论格式条款的法律规制

格式条款有便捷和节省交易成本的优点,但是也容易对交易相对方的利益造成损害,因此对格式条款进行法律规制是必要的。网络交易中的格式条款问题已经向我们提出了新的挑战。我国现在的合同法制度对格式条款的相关规定还不够完备,滞后于格式条款的新发展,有必要对其进行完善,在此过程中要进行博弈,既要维护当事人的合法权益,又要促进交易的进行。

On Rules and Regulations of the Form Clause in Law

The form clause features simplicity and convenience, makes trade faster,and reduces cost of bargain.However,one party providing goods and services may take advantage of his economic position to make form clauses which affect the other party's benefits,so it's necessary to draw up laws about the form clause.Our contract law and related laws also have provisions on the form clause.With the development of form clause,our laws need to be modified to build up more complete system.
