高等院校诊所式法律教育的本土化研究

诊所式法律教育起源于20世纪60年代的美国大学法学院教育课程,是一种实践性质的法律教育课程。这种模式通过设立法律诊所,以学生作为教学的主体,法学教师作为指导,由学生去代理或者以其它方式接触各类案件,接触真实的案件当事人,在法学专业教师的指导下,为当事人处理案件,解答法律咨询。学生在这个过程中学习法律知识,锻炼运用法律解决问题的实际能力,进而缩小理论培养与实践技能的差距。目前,在我国实施本土诊所式法学教育,存在教育理念、教育模式、教育机构等方面的障碍。应结合国情,转变法学教育理念,合理筹化教育经费,并将诊所教育纳入系统法学教学计划。

How to Adapt Clinical Legal Education in Universities to Chinese Conditions

Originated in the curriculum of law colleges in the U.S in 1960s,clinical legal education is a course with practical features.In this teaching mode,a clinic is founded,and students are dominant in the teaching process.Under the guidance of teachers,students contact various cases as legal agents or with other ways.They can meet real parties and deal with their cases,answer their questions.In such a process,students can learn legal knowledge and raise their ability of using what they have learnt to solve real legal cases,thus shortening the distance between theory and practice.Presently,obstacles for adapting clinical legal education to China exist in educational idea,mode and institution.We should change the idea for law education,increase education expense,and include clinical legal education in law education plan.
