| 摘 要： | 离婚纠纷中，非法转移、隐藏共同财产的现象经常出现，现行法律制度对受害一方的保护不尽如人意。因此，为保护受害方，可采取举证责任倒置。对转移、隐藏夫妻共同财产且拒不交出的按偷窃罪追究刑事责任。
