浅议刑事政策观念的变革

刑事政策从萌芽、发展，到成为一门独立的科学，是在与犯罪作斗争的过程中不断完善的。在社会变革时期，刑事政策理论不可避免地会随着时代的发展变化而不断发展和完善，刑事政策的观念应当转变。随着罪行法定原则的确立，人权保障权利入宪，构筑刑事政策的本质内涵，必然是对公权的限制和对人权的保护，因此，有必要重新审视我国刑事政策的价值。

The criminal policy,from it's birth and development to an independent of science,is improving in the fight against crime.In the social reform of china,as the theory of the crime policy inevitably develops with the times,the conception of the criminal policy should be changed.With the establishment of the principles of the punishment-according-to-the-law and the guarantee of human rights being written into the constitution.It is necessary to establish the essence of the criminal policy in the limitation of authoried rights and the protection of human rights.Therefore,it is supposed to re-evaluate the criminal policy.
