摘    要:我国现行《物权法》对于小区车库(位)权属规则的设计存有缺陷.为了进一步解决司法实践中存在的小区车库(位)权属纠纷,在立法上应明确规定小区车库(位)的属性为建筑物区分所有的专有部分.此外,应确立强制性建设与否的划分标准,区分法定车库(位)与非法定车库(位),并根据不同类别分别设立不同的权属规则.

Abstract:Flaws exist in the Property Law about the rules of residential parking places and garages ownership. To combat the issue even further in juridical practice, concrete standards should be proscribed in legislation that the residential parking places and garages is the special part to decide who is the owner of the building. Besides, standards have to be established whether it is mandatory construction or not, whether it is legal or not, and ownership rules should be made according to different types.
