基本权利效力实现途径问题研究

针对基本权利的效力需要由法律的具体化才能实现的观点,分类讨论了基本权利效力的实现途径,概括出基本权利独立的规范价值。虽然不同性质的基本权利的实现途径是不一样的,但基本权利规范都有其独立的价值,主要表现在:基本权利有其独立存在的形态,不因为立法的具体化而失去效力;它的直接效力表现为赋予国家以一定的义务,包括消极的义务和积极的义务,以及对立法进行调控与制约的“高级法”效力;国家没有履行义务而使基本权利受到侵害时,可以提请宪法诉讼。

On Approaches to Realize Efficacy of Radical Rights

In view of the idea that efficacy of radical rights can be realized through embodiment of law,the paper discusses the approaches to realize efficacy of radical rights and generalizes independent normative values.Changeable as the approaches to realize radical rights with different qualities are,they have their own independent values,which embody the followings: 1,radical rights have substantive forms and won't lose efficacy with embodiment of lawmaking;2,the direct efficacy represents certain obligations endowed to the state,including negative and positive ones as well as senior-law efficacy;3,the state will be fired lawsuit when carrying out obligations.
