| 摘 要： | 商标权与在先著作权的冲突是知识产权冲突的表现之一。冲突的原因主要有基于知识产权的本质特性和法律规定的竞合两个方面,我国目前对该项冲突的解决主要有保护在先权利原则和权力丧失原则,在此基础上又提出公平与效益兼顾原则、对权利适度限制原则及经济利益优先原则。

| Abstract: | Copyright and trademark conflict is one of conflicts in Intellectual property rights.The reason includes essential characteristics based on Intellectual property rights and concurrence by law.The present solution involves two principles of protecting prior rights and loss of rights.Based on the two rights, the paper put forward the principle of both equity and efficiency,the principle of appropriate restrictions on the right and the principle of priority of economic interests. |
