| 摘 要： | 目前，我国民法规定胎儿没有民事权利能力．使胎儿的合法权益得不到保护。为了确保胎儿的法律地位，就应当在民法中明确胎儿具有特殊的民事权利能力．同时对胎儿的民事权益的范围及法律保护加以明规定。

| Abstract: | At present, Chinese Civil Laws stipulate that foetus possesses no capability of civil rights, which keeps foetus' legitimate rights and interests out of protection. In order to guarantee foetus' legao status, it should be clearly stipulated in Civil Laws that foetus possesses special capability for civil rights, at the same time, definite stipulation should be made on the scope of foetus' civil rights and interests and legal protection. |
