审判与执行协调运行机制探究

1982的审执分立改革提高了审判和执行的专业化水平，加强了相互监督。然而，审执分立也导致了审理只管判案不考虑执行，直接或问接加剧了执行的难度。审判权和执行权具有同质性和异质性特征及辩证统一关系，只有二者配置上体现相对独立性、统筹兼顾、协调一致的新型运行模式，才能有效解决审执断裂问题，推进我国司法体制改革，实现司法权威和公信力。

On Coordinated Operation Mechanism for Trial and Execution
