摘    要:生产关系是社会关系中最基础的关系,而劳动关系是生产关系的主要内容,构成劳动关系的主体是劳动者和企业,他们分别代表了劳动与资本。在生产过程中,企业追求的是利润最大化,而劳动者则追求工作稳定和收入最大化,这就不可避免产生相互间权利和利益上的矛盾。如果劳资矛盾进一步加剧,就会发生冲突和对抗,破坏社会和谐,影响社会稳定。文章从我国当前的经济转型背景出发,借鉴国外的实际经验,分析我国企业劳资关系不和谐的状况,提出我国企业劳资关系二元所有权构架的构想,探索实施的具体路径。

Abstract:Production relations are the most basic among social relations while labor relations make up the main content in production relations.The main body in labor relations comprises laborers and enterprises that represent labor and capital respec- tively.In the course of production,the enterprises pursue the profit maximization while the laborers pursue stability of work and the maximization of personal income,which will inevitably cause contradictions in their mutual rights and interests.If the labor- capital disputes continue to intensify,they will result in conflicts and confrontations,which are liable to undermine social harmo- ny and affect social stability.Proceeding from China's current economic restructuring background and learning from foreign prac- tical experience,this paper first analyzes disharmony of the labor-capital relationship in the enterprises of China,then the paper proposes the idea of establishing the dual ownership structure in the labor-capital relationship,and finally it explores specific approaches to its implementation.
