| 摘 要： | 管制刑作为我国刑法规定的五种主刑中最轻的一种,是一定社会历史条件下的产物。在新的历史时期,管制刑在我国的司法实践中面临着较为严重的问题,使用率很低,从而引起了管制刑的存废之争。笔者赞同废除论,建议创设社区服务刑罚来代替管制刑,以完善我国的刑罚体系。

| Abstract: | Control punishment,the least severe one among the five main punishments set by criminal laws in our country,is a product under certain condition of the society and history.In the new historical period,control punishment has serious problems during the justice practice,and it is used with low efficiency,as a result,there appears a debate on whether it should exist or not.The author agrees to abolish it,and advises to establish community services instead of control punishment,in order to perfect the punishmen... |
