| 摘 要： | 标的物的占有发生转移即为交付,买卖合同中交付有四种类型,即现实交付、占有改定、简易交付、指示交付。交付是物权变动的一种方式,对于其性质有不同认识。其实交付是一个事实行为。从合同法中可以看出我国立法者也倾向于这种观点。

| Abstract: | Delivery of the object is the shift of owning in the object.There are four kinds of delivery in the contract for purchase and sale in theory.Delivery is a way to shift public real right,but there are different opinions on the quality of the delivery act.In fact,delivery is a factual act.We can find that the law-maker also has this opinion from the stipulation of the Chinese Contract Law. |
