| 摘 要： | 现有的关于正当防卫和防卫过当的表述可以简单地概括为:以正当防卫为基础,讨论正当防卫和防卫过当的问题。这种表述由于立论前提的不当,导致了研究中的一系列问题。为解决现有表述中存在的问题,正确认定正当防卫和防卫过当,应以防卫行为为前提,展开对正当防卫和防卫过当的新表述。

| Abstract: | The present interpretation of self-defense and excessive defense can be summarized as follows: Self-defense and excessive defense can be discussed on the basis of self-defense. Due to its improper presupposition to make a point, a series of questions arise. To solve the questions existed in the present interpretation and to have correct confirmation of self-defense and excessive defense, we should make new interpretation of self-defense and excessive defense with the act of defense as a presupposition. |
