| 摘 要： | 具备目的合理性是土地征收的必要条件,只有直接的公共利益才具有真正的目的合理性。土地征收的困境是公共利益被滥用,政府权力缺乏应有的制约,法律制度设计缺失。要通过土地征收的程序设计、征收动机的抑制机制等措施使土地征收目的回归到直接公共利益上来。

| Abstract: | The rationality of purpose is the essential condition of land collection,Only the direct public benefits has the real rationality of purpose.The predicament of land collection is that the public benefits are abused,the govemment power lacks restriction and supervistion,what's more,the design of law system is imperfection.We must make the purpose of land collection return to the public benefits directly through the program design and the restriction system of the collection motive. |
