| 摘 要： | 本文通过分析物权、债权客体的不同,质疑物权优先于债权,并指出所谓的物权之间的优先效力,其实是先成立的物权优先于后成立的物权,在其中起作用的是时间因素,而不是物权的优先性因素。因此,我们应更新观念,抛弃传统的物权优先效力理论。

| Abstract: | In this article the author oppugns that the effect of property rights is over the effect of creditor's rights through comparision of property rights and creditor's rights'object.Following the author argues that the preferential effect of among property rights means actually that property rights established earlier take precedence of property rights later.It is time that plays an important role in it,but not preferential effect of property rights.At last the author proposes that we should renovate our idea and discard the international theory of preferential effect of property rights. |
