在边缘中生存的我国私家侦探业——取缔抑或规范

我国实务界和学术界对私家侦探业的发展一直存在着反对与支持两种声音。本文从其对侦查权和隐私权的侵犯两方面总结了反对的原因,又从供求关系、法律空间、司法资源的现状和国际影响等方面提出了支持的因素,并进一步从侦查权与调查权、隐私权与知情权的论争中指出了我国私家侦探业合法性的理由。

Private Detective Survival at the Edge of Law: Banned or Standardized

There have been two different opinions - for or against - the private detective. The article sums up the opposition reasons based on infringement of right of investigation and privacy. It also proposes supporting factors from the relationship of supply and demand, legal space, present situation of judicial resources and international influence. Then it elicits reasons of legitimacy of private detective in China from discussions between the rights of detection and investigation, the right of privacy and the right of being informed.
