对我国物业管理立法若干问题的探讨

摘    要:《物业管理条例》于2003年9月1日开始实施.但该条例对物业管理关系中的三方关系即业主大会、业主委员会、物业管理企业之间的关系仍然不明确;物业管理模式单一;对业主大会、业主管理委员会的权利义务、责任分担不清,规定不够细致、配套规定少等原因,造成具体实践中可操作性不强.建议:我国的物业管理宜采用物业公司管理与业主经营式管理并用的两种模式,同时应明确界定物业管理中业主大会、业主委员会、物业管理企业三者间的相互关系,明确业主委员会为具备法人资格的其他组织.

Abstract:Regulations on Property Management was enforced on Sep.1,2003,but a number of ambiguities are existent in the regulations.The relationship between Property Owners' Congress,Property Owners' Management Commission and property management enterprises is not well defined with ineffective modes of property management and not clear defining of the rights,obligation and responsibilities of Property Owners' Congress and Property Owners' Management Commission and inadequate and incomplete matching regulations,causing impracticable operation in reality.It is suggested that property management should adopt the parallel management of property enterprises management and property owners' management,that the relations between Property Owners' Congress,Property Owners' Management Commission and property management enterprises be well defined and that property owners' commission should be regarded as an organization with lawman qualification.
