辩诉交易中国化

在全球一体化以及各种文化舶来品的影响下,我们不断地吸收着来自世界各方的有利我中华之崛起的知识文化,我们相信师夷长技艺以制夷,所以我们学习,以倡导包容兼通与各家文化的和谐发展。法律,作为上层建筑的中坚力量,理应也与时俱进,我们在不断倡导人权,倡导公平与效率,同样需要的是一种能够将这种口号付诸实施的方式,于是学界中有了关于辩诉交易,有了刑事和解的大量探讨。笔者通过本文,即将讨论如何、为何要将辩诉交易中国化的问题,以及辩诉交易中国化所可能产生的后续尚待解决的问题。
