| 摘 要： | 商标权与域名权在构成要素、表达方式、功能上有一定联系，也存在一定的区别。造成二者在知识产权范围内冲突的根本原因主要是两者的权利性质和商务价值，当然也有法律规定的不足。要解决这些冲突，必须通过行政途径、司法途径、仲裁和调解途径来进行。

| Abstract: | There are relations, as well as difference ,between brand right and domain name right. The primary conflict in intellectual right domain is resulted from the property of right and the commercial value. The possible solutions may call for the cooperation of administrative ,judicial, arbitrary, and mediating approaches. |
