| 摘 要： | 最高人民法院和最高人民检察院(以下简称“两高”)的司法解释权是全国人大授予的,但由于“两高”的司法解释权具有内部效力,不具有普遍约束力,故“两高”常常为了自己的利益而越权解释或使解释范围扩大等,从而严重损害了全国人大的权威。为了遏制这种不良倾向,有必要对司法解释权扩大化的表现及成因作分析。

| Abstract: | The Supreme Court and the Supreme Law-office("2 Supremes" for short in the follwing text) receive their power of judicial interpretation,which has no universal sanction sanction but only internal force,from the National People's Congress.For their own interests,2 Supremes frequently exceed their authorities and abuse or expand their power of judicial interpretation,which have badly injured the supreme authority of the National People's Congress.In order to keep this negative tendency within linits,it is necessary to analyze the reflections and reasons of the expansion of judicial interpretation. |
