中国近代法学教育肇兴及反思

19世纪60年代洋务派创办京师同文馆设置了国际法教育,开启了近代法学教育之路。从19世纪末维新派倡导西学,法学教育全面兴起,到20世纪初晚清新政期间,借助修律活动,中国近代法学教育从深度和广度均取得飞跃发展。中国近代法学教育的肇兴与民族矛盾日益加深、自救图存抵御外侮的社会环境紧密相连。一方面培养了大批新式法律人才,促进中国近代法学的产生;另一方面,因缺乏本土性,移植色彩浓厚,又带来诸多弊端。反思中国近代法学教育有助于当代法学教育的完善。

Development and Reflection of Chinese Modern Legal Education

In nineteenth Century 60 schools Tungwen College set up international law education to open the road to modern legal e-ducation at the end of nineteenth Century,the reformists advocated Western learning,comprehensive and arisen,early twentieth Century during the new deal in the late Qing Dynasty,with the activities of the amendments to the law,Chinese modern legal education from the depth and breadth of both achieved rapid development.Chinese modern legal education development and ethnic contradictions,self exis-tence social environment are closely linked to resist foreign aggression.On the one hand,it helps to train a large number of new legal talents,promote the China modern generation of law; on the other hand,because of the lack of local transplantation,strong color,and bring many disadvantages.Perfect for its reflection is helpful for the contemporary legal education.
