我国刑事法律援助质量控制研究

现行《刑事诉讼法》着力扩大了刑事法律援助的范围，但对于法律援助质量的问题却没有给予同样的关注。当前刑事法律援助质量堪忧主要是由质量保障制度缺位、经费有待落实以及承办律师的责任心等因素共同形成。因此，刑事法律援助走出“泥潭”的途径就在于制定操作性强的质量监督保障机制，强制落实刑事法律援助的最低标准；同时切实落实好律师承办法律援助案件的办案费用，以提升承办律师的积极性和责任心。从而在主客观两个方面上保障刑事法律援助的质量。

Research of Quality Control of Our Criminal Legal Aid

The present ＂Criminal Procedure Law＂ broadens the range of criminal legal aid, but does not pay attention to its quality. The quality is not good because there is not a quality insurance system, the funding for it can hardly be fulfilled, and the undertaking lawyers are short of responsibility. Therefore, if we want to help criminal legal aid to go out of the dilemma, we must formulate a quality supervision mechanism which is easy to operate so as to implement the lowest standard; at the same time, we must guarantee the expense for the undertaking lawyers to upgrade their activity as well as responsibility. Thus the quality of criminal legal aid can be guaranteed both subjectively and objectively.
