试论行业协会的法律定位

随着市场经济的发展，各种行业协会发挥着越来越重要的作用。由于实践中行业协会的角色定位模糊，规范混乱，行业协会在其发展中暴露出越来越多的问题，发生角色冲突。因此，必须明确行业协会的法律定位。行业协会具有民间性、自治性（非政府性）和非营利性的特征，由此决定了行业协会的主要职能为自律、维权、协调、服务与交流，不宜将政府的行政职能赋予行业协会，行业协会只有在经授权或委托的情形才具有被授予或委托的行政职能。行业协会具有双刃剑的作用，法律必须对行业协会的基本职能作出明确的规定，并对行业协会的行为做出禁止性规定。
