毕业生“召回”制度的法理思考

产品召回制度近年来被引入了教育领域并引起广泛争议。从法律的角度来看,毕业生召回制度中存在许多问题:高校、毕业生和用人单位之间形成了不同的法律关系,高校无权对毕业生进行召回;毕业生"不合格"的判断标准存在随意性;高校对毕业生的强制召回可能会侵犯学生的自由选择权等。因此,不宜在高校推行这项制度。

The Legal Thinking on Graduates Recall System

Products recall system is a system of renovating the inadequate products. When this concept is introduced into school, it sparks a heated discussion debates. The system has many problems in legal dimension： universities, graduates and employers formed different legal relationships, so universities have no right to recall the graduates. The judgment standard of ＂unqualified graduates＂ is arbitrary. The universities recalling the graduates forcibly may violate the students＇ freedom of choice. Therefore, this system should not be practiced in colleges.
