| 摘 要： | 我国新婚姻法确立了离婚损害赔偿制度，这是立法的一大进步，但依据这一制度却无法解决司法实践中存在的婚内索赔问题。因此，为了充分保护无过错方的合法权益，我国的婚姻法应支持无过错方在婚姻关系存续期间提起的损害赔偿要求。

| Abstract: | It's a progress in our legislate that divorce payment is admitted by our new marriage law,but the judicial practice can't be solved effectively in the light of the law. In order to protect lawful rights of agent without fault, our marriage law should support the payment demand of agent without fault during the survival of marriage. |
