| 摘 要： | 反向假冒商标是指未经商标权人许可，消除他人的商标而将自己的商标用于他人的商品或腮务上进行销售的行为。通过对理论界关于商标反向假冒中几个争论较大的观点进行探讨，可以发现，商标反向假冒不仅构成侵权行为，而且构成对商标权的侵害。

| Abstract: | Trademark reverse passing off is an illegal act of changing or removing others＇ registered trademarks without permission and putting in others＇ commodities to the market. The author researches several points of trademark reverse passing off that have been discussed intensely in the intellectual field, and suggests that trademark reverse passing off is not only a tort, but also an infringement of the trademark right. |
