行政调查是行政机关进行行政管理、作出行政裁决的先决程序，不仅如此，行政调查发展至今已成为行政管理中一项独立的制度。在行政管理活动重要的今天，行政机关的行政调查权与公民的人身自由权、营业自由权、住宅权和隐私权等宪法上的基本权利存在某种程度的张力，本文从一个案例入手，分析了行政调查制度的特征、发展、以及行政机关的行政调查权与公民基本权利的关系，企图寻找两者的平衡点。

On Constitutional Foundation of Administrative Investigation

Administrative investigation is the prerequisite procedure for administrative bodies to carry out administrative management and administrative adjudication. Furthermore, it has been developed into an independent system in administrative management. The right of administrative investigation, along with the right of citizens' personal liberties, the right of freedom of business, the right of dwelling house, the right of privacy and other basic rights in the Constitution, has an increasing importance to a certain extent. According to a case, the paper makes an analysis of features and development of administrative investigation system as well as relationships between the right of administrative investigation and citizens' basic rights in order to seek the balance point between both.
