| 摘 要： | 波兰通过1982年的宪法修正案和1985年的《宪法裁判所法》引入宪法审查制度。1989年波兰社会制度发生转型,不过宪法审查制得以保留,但是宪法审查的性质和功能已发生根本转变。1997年波兰通过现行宪法,新宪法成为新的制度背景下宪法审查制的基础。基于对不同历史时期的两部《宪法裁判所法》及其宪法基础的分析,以此揭示波兰宪法审查制在性质、功能等方面的变迁。

| Abstract: | Poland amended the Constitution in 1982 and issued Constitutional Tribunal Act in 1985.In this way,poland introduced the constitutional review system.The constitutional review system was remained in 1989,although the social system changed.In 1997 Poland has drawn up the contemporary constitution,which laid the foundation of the constitutional review system.This article discusses the transformation of the constitutional review system in Poland through analysis of the two acts about constitutional tribunal. |
