论我国的夫妻财产约定制度及其立法完善

夫妻财产约定制是我国夫妻财产制度的一项重要内容，2001年修改后的婚姻法较完整地确立了夫妻财产约定制度。在一定程度上完善了我国夫妻财产制度，但现行的夫妻财产约定制仍存在一定的缺陷和不足，立法必须不断加以完善，从而更好地避免和解决夫妻财产纷争，保护第三人利益。维护社会的和谐稳定。

On the Agreement System of Marital Property and its Legislation in China

The agreement system of marital property is one of the important points in Chinese marital property system. Since the revision of Marriage Law in 2001, this agreement system has become more complete. To some extent, it makes the system of marital property improved. But the current agreement system of marital property is still flawed. The legisla- tion of it needs perfection so as to prevent and solve problems in the disagreement of marital and to property, to guarantee the legal rights of the relatives involved, and to keep the stability and harmony of the society.
